Remote Work from Georgia – One-Year Stay and Employment of a Foreign National

I. Remote Work in Georgia – Case Overview

TB Legal provided legal assistance to an Indian citizen residing in the United Arab Emirates who was planning to relocate to Georgia for one year.

The client was employed by a foreign company and intended to continue working remotely for the same employer after relocating to Georgia.

The main legal challenge was that the right to legally reside in Georgia and the right of a foreign national to engage in employment activities are governed by separate legal requirements.

Accordingly, it was necessary to identify an appropriate legal mechanism that would accommodate both the client’s long-term stay in Georgia and the continuation of remote employment.

II. Legal Challenge – Residence in Georgia and Employment by a Foreign Company

Two principal legal issues emerged during the assessment of the case.

The first concerned the legal basis for the client’s entry into Georgia and lawful stay for one year. Although the client was residing in the United Arab Emirates, their existing immigration status required further legal assessment.

The second issue concerned remote employment.

The client did not intend to take up employment with a Georgian company. Instead, the objective was to maintain the existing employment relationship with the foreign employer while performing work remotely from Georgia.

This circumstance was of decisive legal significance, as Georgian legislation provides special rules for certain categories of remote work performed for foreign companies.

Resolving the matter required a careful assessment of whether the client’s individual circumstances satisfied the conditions for applying the relevant legal provisions.

III. TB Legal’s Legal Approach

TB Legal’s legal assessment focused on the specific nature of the client’s employment activities and the intended duration of their stay in Georgia.

The review covered the client’s existing immigration status, the legal nature of the employment relationship with the foreign employer, and the conditions under which the client intended to perform work from Georgia.

Particular attention was given to the interaction between Georgian immigration legislation and the labour migration regulations applicable in 2026.

The legal analysis identified the potential applicability of a special regulatory framework, which was particularly relevant to determining the client’s lawful stay and ability to continue working remotely from Georgia.

The assessment also examined the requirements for using an appropriate visa mechanism and the supporting documentation necessary for the relevant immigration procedure.

IV. Case Outcome – Identifying an Appropriate Legal Pathway

As a result of the legal assessment, an appropriate legal strategy was developed for the client’s intended one-year stay in Georgia while continuing remote employment with a foreign company.

The assessment identified a relevant visa mechanism and the conditions under which the client’s objectives could be achieved.

It also addressed whether the client’s activities would be subject to the requirements for obtaining the right to work in Georgia.

The case demonstrated that assessing a foreign national’s employment status in Georgia may depend not only on the physical location where work is performed but also on the employer’s legal status, the nature of the activities, and the purpose of the foreign national’s stay in Georgia.
