Successful Challenge of an Approximately GEL 2,363 Electricity Overbilling Charge in Georgia

I. Electricity Overbilling Dispute – Case Overview

TB Legal provided legal assistance to a consumer in challenging an approximately GEL 2,363 electricity charge imposed by an electricity supplier.

The disputed amount differed significantly from the consumption levels normally recorded at the property. Review of the circumstances showed that electricity consumption during the disputed period was substantially higher than both the client’s historical consumption and the levels recorded after replacement of the electricity meter.

TB Legal assessed the consumption history, metering circumstances and the regulatory basis of the disputed charge and prepared the legal position necessary to protect the client’s interests.

The matter was brought before the Georgian National Energy and Water Supply Regulatory Commission (GNERC).

As a result of the legal challenge, the approximately GEL 2,363 disputed charge was reviewed and the electricity supplier was required to recalculate the bill in accordance with the applicable regulatory rules.

II. Abnormal Electricity Consumption and Legal Review of the Bill

A significant increase in an electricity bill does not, by itself, establish that the corresponding volume of electricity was actually consumed.

Where a billing anomaly arises, it may be necessary to compare the disputed reading with the customer’s historical consumption, metering data, circumstances relating to the meter and consumption recorded during subsequent periods.

In this matter, the data showed a sharp and unusual increase during the disputed period.

Of particular significance was the fact that, after replacement of the meter, electricity consumption decreased substantially and returned to levels more consistent with the property’s previous consumption pattern.

The disputed bill therefore required assessment in the broader context of the client’s consumption history and the circumstances surrounding the electricity meter.

III. Metering Data and Consumption History

One of the central issues in an electricity billing dispute is whether the metering data used for billing accurately reflects the consumer’s actual consumption.

TB Legal’s legal position focused on the circumstances of the matter as a whole, including the client’s historical consumption, the significant increase recorded during the disputed period, circumstances relating to the meter, consumption following replacement of the meter and the regulatory basis used for the calculation.

These elements were assessed together in order to determine whether the charge imposed on the client complied with the applicable electricity supply and billing rules.

GNERC expressly allows consumers to request verification of utility billing, including where the recorded kWh, tariff, billing period or other information in an electricity bill may be incorrect.

IV. Challenge Before the Energy Regulator

Following the review of the factual circumstances and consumption data, the legality of the disputed charge was raised before GNERC.

TB Legal prepared the legal position supporting further examination of the bill, with particular emphasis on the client’s actual consumption pattern and the metering circumstances.

The regulator reviewed the circumstances surrounding the disputed charge and assessed its compliance with the applicable electricity supply and consumption rules.

Following that review, the electricity supplier was required to bring the disputed billing into compliance with the applicable regulatory requirements and correct the calculation.

V. Outcome – Correction of the Disputed Electricity Charge

As a result of TB Legal’s legal intervention, the approximately GEL 2,363 electricity charge was reviewed and corrected.

Following the regulator’s involvement, the electricity supplier was required to recalculate the disputed amount in accordance with the applicable regulatory rules.

The original charge therefore did not remain unchanged, and the client’s interests were successfully protected through the regulatory process.

The matter demonstrates that where an electricity bill is unusually high, proper legal assessment may require more than a review of the individual invoice. Historical consumption, meter data, technical circumstances and the methodology used to calculate the bill may all be relevant in determining whether the charge is legally justified.
